What is a trademark?

A trademark is a type of intellectual property protection that identifies the products or services belonging to one company from other companies and is capable of being represented graphically.

There are two conditions for registering a trademark in Indonesia: first is that you are already using the mark, and second is that you plan to use it shortly. Your trademark must be active continuously for a minimum of three years to avoid the non-use cancellation action.

Words, names, phrases, letters, designs, indications, numerals, colours, scent, sound, signs, shape of goods, aspect of packaging or any of these combined, are qualified for being trademarked.
CANNOT
Any work that is protected by copyright such as books, drawings, films, songs, theatrical performances or any form of creative work is not subjected to be trademarked. Additionally, business methods, inventions, mechanical devices and processes cannot be trademarked as utility patents protect them. Any intellectual property cannot protect ideas alone; they would need to be tangible to be eligible.

To file a trademark application in Indonesia, you will need:

  • The Power of Attorney
  • The details of the owner of the trademark
  • A clear graphical representation of the trademark
  • A list of goods and/or services sought for registration, classified according to the international classification of goods and services
  • A declaration of use or intended use of the trademark

1. Conducting a comprehensive study or trademark search

We will need to search the trademark register to ensure that no similar trademarks have previously been registered in Indonesia as well as ensure that the trademark complies with the Trademark Act. After conducting a trademark search, the statement will include an overview of the availability of the trademark you want to register.

2. Submitting the registration request

Next, we will prepare and submit your trademark application at the Directorate General of Intellectual Property. Once the application is filed, there will be a period where objections can be made against its registration by the Trademark Office. Acclime will assist in resolving any such objections that arise.

3. Obtaining the registration certificate

Once resolved, or if no objections are raised, the trademark will be registered. The trademark is then published, and objections by third parties can be made within 90 days of publication.

How much does it cost to register a trademark in Indonesia?

How long does it take to register a trademark?
It would take about 14 to 24 months to process and approve the trademark application.
Can I register a trademark by myself?
If it is done by a PT PMA in Indonesia, the trademark registration application can be done online. However, foreign applicants require a local Intellectual Property Right Consultant with a signed Power of Attorney and Declaration of Entitlement in order to file for the processing of their trademark registration application.
What are the types of trademark?
There are some types of trademark; a word or a combination of words, letters, and numerals can perfectly constitute a trademark. But trademarks may also consist of drawings, symbols, three-dimensional features such as the shape and packaging of goods, non-visible signs such as sounds or fragrances, or colour shades used as distinguishing features.
Is a trademark valid worldwide?
At the worldwide level, you have two options: either you can file a trademark application with the trademark office of each country in which you are seeking protection, or you can use WIPO’s Madrid System. WIPO’s Madrid System can be used for registering and managing trademarks worldwide. By registering a single application, this can be applied for protection in up to 122 countries.
